How can we help

Following a death of a person it is necessary to organise and regulate the deceased’s affairs.  Michael & Company provide efficient and friendly service aimed at obtaining the Certificate of Probate or Letter of Administration as soon as possible.

Michael Shpaizer will personally carry out all the work required.  Michael will deal with HMRC with a view to finalise the tax position of the deceased.   He will also deal with the relevant banks, building societies, life assurance companies and all other persons with a view to collect all monies due to the deceased’s estate.  This will enable the payment of any debts, tax and legacies to beneficiaries.

Michael will keep you informed as to progress so that at all time you know what stage has been reached.  He can also assist the executors or administrators to discharge their obligations under the deceased’s Will or the rules of intestacy.  At the conclusion of the probate work, Michael will provide a detailed statement of account showing all the payments received and made.

Our Pricing and Transparency - Applying for the grant, collecting and distributing the assets

The Solicitors Regulation Authority published new rules that make it mandatory for all regulated firms of solicitors to publish information on the prices they charge.  In order to comply with these rules, we set out in this section the minimum price we charge and service we provide.  We would like to be clear about these so as to avoid any misunderstandings.

We would like to ensure that our clients have as much as possible information to help them make an informed choice before they instruct us to act.  It is important for us that our clients understand as soon as possible what legal costs and disbursements they may have to pay for our legal services.

We charge a percentage of the gross value of the estate with a minimum fee of £1,950 (plus VAT at the rate of 20%). Once we are able to estimate the value of the estate, we will able to tell you the exact amount we charge and any other costs that you may incur.

The exact cost will depend on the individual circumstances of the matter. For example, if there is one beneficiary and no property, our costs will be at the lower end of the range. If there are multiple beneficiaries, a property and multiple bank accounts, costs will be at the higher end.

We usually charge a fixed price but in the event that you require additional work, our hourly rate is £195 (plus VAT at the rate of 20%).

Michael will handle the full process for you. This quote is an example for estates where:

  • There is a valid will
  • There is no more than one property
  • There are no more than one bank or building society account
  • There are no other intangible assets
  • There are no more than two beneficiaries
  • There are no disputes between beneficiaries on division of assets. If disputes arise, we will cease acting.
  • There is no inheritance tax payable and the executors do not need to submit a full account to HMRC
  • There are no claims made against the estate

Disbursements included in this fee:

  • Court application fee of £155 (VAT is not payable)
  • Bankruptcy-only Land Charges Department searches (£3 per beneficiary, VAT not payable)
  • Post in The London Gazette – Protects against unexpected claims from unknown creditors.  Prices for this advertisement change from time to time and we will ascertain the exact amount payable and let you know before incurring any cost.
  • Cost in a Local Newspaper – This also helps to protect against unexpected claims. Prices for this advertisement change from time to time and we will ascertain the exact amount payable and let you know before incurring any cost.

Disbursements are costs related to your matter that are payable to third parties, such as court fees. We handle the payment of the disbursements on your behalf to ensure a smoother process. Prices may vary and we will ascertain the exact amount payable and let you know before incurring any cost.

Potential additional costs

  • If there is no will or the estate consists of any share holdings (stocks and bonds) there is likely to be additional costs that would vary depending on the estate and how it is to be dealt with. We can give you a more accurate quote once we have more information.
  • If any additional copies of the grant are required, they will cost £1.50 per additional copy and VAT is not payable.
  • We will be happy to assist you with dealing with the sale or transfer of any property in the estate at an additional cost.

As part of our fee Michael will:

  • personally work on your matter
  • help you identify the legally appointed executors or administrators and beneficiaries
  • identify the type of Probate application you will require
  • help you complete the relevant IHT forms
  • obtain the relevant documents required to make the application to the Probate Court
  • complete the Probate Application and the relevant HMRC forms
  • make the application to the Probate Court on your behalf
  • Once the Probate Certificate has been issue, Michael will securely send it to you
  • If you require further assistance, Michael will help you to collect and distribute all assets in the estate

How long will this take - on average, estates that fall within this range are dealt with within two to three months. Typically, obtaining the grant of probate takes 8 to 12 weeks. Collecting assets then follows, which can take between 5 and 10 weeks. Once this has been done, we can distribute the assets, which normally takes 1 to 2 weeks.
